Open Post

Well kids, for far too long we have tolerated too many posts that have done nothing to elicit discussion or promote the sharing of information throughout the department. We have strayed from our original purpose. For this thread we will be moderating comments more strictly. You, the poster, will be held to a higher standard.

You will not rat each other out in here. It sickens us that some would feebly and transparently endeavor to create bad press for the Sheriff at the expense of officers. The end does not justify the means and it'll never see the light of day. In this comment thread you will not insult or attack each other. You may offer criticism if it is constructive and we encourage you to include a suggested solution to actions criticized. Humor is still welcome, but tread lightly.

When asking the blog operators a question please email instead of posting it in the comments.
When posting links please preface the link with brief description.

The number of views/posts means nothing to us. We don't get paid to do this.

Heard through the grapevine some very interesting info about opr. Apparently the deputies and c.o.'s are being promised sheriffs police spots when their tour in the rat squad is finished. The sad fact is that they believe it.

Wonder if the union, during the hearing for arbitration, will bring up the fact that there are 176 exempt positions in the sheriff's dept. With an average salary over 100k. Would love to know what the county's answer to that would be when they are crying poor.

An inmate who allegedly received a box of marijuana-filled ballpoint pens from a Cook County sheriff's deputy is facing a felony contraband charge for the transaction.

But, in a dispute over the investigation between sheriff's investigators and the Cook County state's attorney's office, prosecutors declined to charge the deputy who was arrested earlier this month for allegedly hand-delivering the drugs inside the Cook County Criminal Courts Building at 26th Street and California Avenue.

"We are still at a loss as to why this particular case did not get charged," Joe Ways, head of the sheriff's Office of Professional Review, which investigates employee misconduct, said Tuesday.

The state's attorney's office said the case fell apart because sheriff's investigators did not follow specific instructions designed to ensure they had the evidence they needed to show the deputy knew she was delivering drugs to inmate Brian Goolsby, 28.

"It was clear that she knew she was transporting a box of something, and it was probably clear that she knew she was transporting pens," said Dan Kirk, chief of staff to State's Attorney Anita Alvarez. "We would have gladly charged her had the evidence been sufficient, as we have in many other cases. It just simply wasn't there."

The 40-year-deputy -- whom the Tribune is not identifying because she has not been charged with a crime -- was arrested July 1 after she allegedly delivered the pot-stuffed pens to Goolsby when he appeared at the Criminal Courts Building for a routine hearing in his pending murder case.

While court was in recess for lunch, a cooperating witness who had been wired delivered the box of pens to the deputy in a courthouse hallway, allegedly discussing the drugs stashed inside, Ways said. Moments later, the deputy went into an adjacent lockup area where a handcuffed Goolsby was being held. While investigators secretly watched, she allegedly delivered the box through a hug.

The investigators moved in and recovered the box from Goolsby and found that one of the pen caps had been removed, revealing the marijuana.

"Because of the speed of the series of events, one would have to surmise that she opened one and saw what was in there," Ways said.

But that assumption was a key sticking point for prosecutors, who said no one actually saw her open the pen. In addition, the deputy, who is hearing impaired, denied she knew about the drugs and said she didn't hear what the cooperating witness said in the hallway.

A source familiar with the investigation said prosecutors asked that the sheriff's investigators leave the marijuana exposed and visible so the deputy would be hard pressed to claim ignorance. Instead, the pens were closed before the exchange. Despite the fact that one pen had been opened afterward, no one can testify they saw the deputy do it, the source said.

Additionally, an earlier recorded telephone conversation between Goolsby and the witness suggested the deputy was unaware of the drugs.

"For all she knows, she's just getting pens," Goolsby allegedly told the witness, referring to the deputy.

Goolsby was charged Monday with possession of contraband in a penal institution and is expected to appear in court Wednesday. Meanwhile, the deputy has been suspended with pay for delivering the box of pens, a department violation. Ways said the sheriff's department is moving to fire her.

Private companies are successful because they keep their recipies a secret. Good media coverage is non-biased, meaning when we do good or bad, tell the public. Just don't give away the tricks of the trade.
Tom Dart is a great Sheriff...if this were a law firm trying to make headlines, but it's not! This is an organization with three law enforcement departments each serving a distinct purpose. The days of solving cases, showing Police presence on the streets, enforcing code of conduct in the halls of the court and maintaining order within the jail seems to be a thing of the past and it's a damn shame.

This is just the tip of the iceberg between the state's attorney's an OPR. Many of OPR's agents are EX State's Attorney's who left before Alvarez fired them. Watch the maywood case fall apart.. The state did not wan't to charge the deputy untill OPR really pushed the case. Alvarez hates Dart and will embarrass him whenever she can. I have a feeling that the state will not procecute the maywood officer as hard as they can. Plus they know the case is bull shit..

The question is why the Ex States attorneys in OPR are so anti=police. Is that why Alvarez wanted to get rid of them?

Hey Mr. Ways, where in law enforcement did you work where assuming something has legal standing? "Due to the speed, we can assume she opened it." The s.a. office wants to win cases you fool. I assume you have never made a felony arrest due to track record of fuck ups, am I right? Is this deputy guilty? Most likely yes. Remember this phrase sir, its the most true in law enforcement. We talk each day about how bad morale is becoming in our department. Why are we allowing it to happen? Regardless of what the highers up try to do, we should try to figure out ways to beat them. We should unite, go to work and do our jobs. If you have something that you can't handle slow it down,take your time,ask for help, be safe and do it correctly. we should look out for each other to prevent each other from acting dumb. It is hard and we wonder is it worth it, yes it is.

Every American other than police officers has an absolute right to remain silent when under investigation. Police agencies have the difficult job of sorting out events to determine if their officers are acting within the law and established department policies.

The police agencies have determined a way to obtain their officer’s cooperation during internal investigations through immunization agreements that preclude those statements from being used in court against the officers.

Because of the Cozzi opinion any officers who cooperates with the department during an internal investigation are fools that can expect to see whatever they say used against them anyway.

Any officer that has to for example, use any force whatsoever is crazy to make a written report or submit to an interview. The administrative rights practice is worthless and void.

It would then be wrong to fire officers that simply refuse to incriminate themselves. Cops deserve no fewer rights than any other citizen. The right to remain silent is sacred. Waiving that right may earn you a prison cell, disgrace, your pension and your life.

This really means that if cops simply don’t make arrests, they will never need to use or explain why they used force to make an arrest. Making arrests is hazardous to officer's careers and freedom.

The Cozzi case is now the law of the land unless overturned by the US Supreme Court:

Absorbe what you read, respond accurately. The US Supreme Court did NOT hear the Cozzi case, the
7th Circuit Court of Appeals for the Northern District of Illinois rendered the decision. The Supreme Court is the next step in the process.

I know this is a Ohio Supreme Court decision, but a few cases have stemmed from the United States Supreme Court as well.

Supreme Court ruled that, Not only can the internal/Administrative statement of a police officer NOT be used in ANY criminal proceedings, but the actual internal file may not even be given to the States Attorney at all. Any internal/Administrative (Garrity) statement and any fruits (including witnesses) derived from that statement are Completely forbidden for use in Criminal Proceedings.

These budget problems are just the tip of the iceberg. Municipal finances are bad everywhere.

If we (Cook County) were in such wonderful shape, don't you think the Toddler would be touting it, lame duck or not? I am fearful that when Preckwinkel gets elected she will a few weeks after being sworn in drop an atom bomb on us. Chicago is 600 Million in the red. How do you make that go away? Cutting pencils and paper clips won't do it. It will be in employee costs. Hundreds of employees will need to be let go. There is no way around it.

For a moment put aside all of the JG/Police/Court crap and think ABOUT and FOR the future. While you are at it say a prayer for all of those hardworking police officers that lost their jobs for no real good reason.

I dont know but regardless it sounds like they did the right thing that night and may have well saved a life or future lives down the road (including LEO's). The 10 hour shifts at 26th street while nice in theory, they are not going well. Unless you have a vacation already approved or playing the fmla card, good luck trying to get a day off. If we had the people, the 4-10's are great, more time working but less days having to be there. Even if you are someone who hides most of your day, you will be tired at the end of a 10 hour day. We all have to do more work to make up for the smaller amount of manpower. facilities that have large amounts of whiners make any shift or time of day unbearable.

Yeah and the custodian who was caught numerous times, drinking on the job, only seeked help from EAP after she was written up. How did she get away with that one? Does OPR play favorites if you happen to have a certain skin color? I thought they told us in the academy that if you have an alcohol or drug problem you have to seek help from EAP, before you get caught in order to save your job?

Their are more victims that have not come forward with that specific Sgt. One called me up about a year ago who was being harrassed by him. She was upset and crying uncontrollably. I told her to file a complaint. She was afraid cause she new it would be buried by Opr and internal affairs like all the other Complaints. I hate to pull race into this. But could you imagine if this was a white Sgt with five complaints against African American women. It would not be tolerated for five minutes-nor should it be.

The Illinois Department of Corrections said they didn't learn of Rice's admissions until 2008, then turned the case over to the Cook County sheriff's police. Rice was charged with Eddie's murder that year.

At Rice's bail hearing for Eddie's murder, Assistant State's Attorney Bill Delaney said Rice told one prison staff member that he "got away with murder because there was not enough evidence."

Sadly, just a matter of time. Im afraid were stuck with him. Currently no open offices for him to run for. Remember the days when if someone was off they filled that spot. Now 20 people could be off and they won't replace any of them. Not to mention Opr pulling half the dept off duty. And our fearless leaders just keep telling him what he want's to hear. Everytime he does the Glenn Beck Chalkboard act at the Accountability meetings. All the Chiefs sit their without disputing anything. Then they pat him on the back and tell him how great he is. The sheriff is happier than a kid in a candy store. Whatever happened to the days when the deputies ran 26th street. They covered each other and worked together and got everything done. But in the last 6 years the recruits that came out were white shirt asskissers. They don't know the meaning of working together with other deputies. They just want to kiss up a white shirt so they won't have to do anything.
